  PAIN-L:

Although I am a relatively new member, I have 14+ years experience with pain,
with over 6 total surgeries, and the torment of constant pain. And I would
like to remind each and every one of you of the following. Some of this is
obvious, some, in all the noise, we tend to forget. I am here to remind you
of what you may know deep down inside, but forget amidst the 'battles' we all
face, on a variety of fronts.

  Here they are:

  1. You are a human being with the right to be treated so,

  2. You have the right to be treated with respect

  3. you have the right to be treated with dignity

  4. you have the right to expect your privacy to be kept intact

  5. You have the right to expect your statements to physicians to be held in
  the strictest of confidence.

  6. You have the right to be treated with the best modern medicine can conjure
up for your particular illness. And with compassion, not intolerance and
  indifference..

  7. You have the right to expect not to be assaulted or have a character
assassination launched against you in the event you are run over by a truck,
injured, develop a disease, or are involved in a mugging, workplace accident,
traffic accident, or other incident which injures you. You need not be burned
by an accident, then burned by the insurer, then burned by their
suit/lawyers. Believe me, they are merciless.

  8. You have the right to expect every word you tell your doctor(s) NOT to be
broadcast across the north american continent, ridiculed, mocked, or read
aloud, or loaded onto a coast to coast national or international consolidated
medical database, available to employers, insurers, your boss, your teachers,
or professors, etc. Or sold to private eyes, Private medical information
warehouses, or other third parties that can USE YOUR MEDICAL information,
including extremely sensitive, embarassing, and potentially damaging
information (you thought you gave in total confidence) AGAINST YOU.

  9. You have the right to expect YOUR physician to be YOUR patient advocate,
to do everything in his or her powers, to help you, and mitigate your
suffering. You have the right to pain relief. You also have the right to be
told up front, with total candor, the HONEST, forthright reason sensitive
information is needed, and for what purpose it will be (and can be used).
  Often against you.

  10. You have the right, when you are disabled, to be treated with fairness
and not be subjected to a vicious witch hunt for irrelevant dirty laundry,
from your past, for which can be used to attack, belittle you, assault your
character, in order to dodge claims. If you are asked extremely personal
information in any rehab or hospital, or by any doctor, do not respond until
you have sought the advice of your lawyer. Anything you say or do can and
will be used against you later on.

  11. You have the right to defend yourself, hire a lawyer(s), and expert
witnesses (sometimes the ONLY way to beat the 'system'). I tenaciously ask
patients to find and hire tough lawyers; the folks you file claims for injury
  will!

  12. You have the right to decide whether your ENTIRE medical history can or
cannot/ should or should not, be loaded into some computerized, consolidated,
coast to coast cradle to grave medical database, available to virtually
  anyone.

You are entitled to expect NO unauthorized access to your medical files, or
sale or trafficing of them. Never obtain an AUTO INSURANCE POLICY THAT SAYS
IN THE FINE PRINT 'I AGREE TO PROVIDE ANY AND ALL INFORMATION REQUESTED BY
THE INSURER". It means they can ask and get your entire personnel history
(for life) AND your entire medical history, and can drop your claim if you
refuse to allow them full access. Believe me when I tell you, they are not
needing that information to *help* you. They are looking for dirty laundry to
  use against you.

However, as Your moderator can brief you, there are bills in congress to
dismantle each and every right and expectation listed above. There are many
amazing medical healers and fantastic health advocates in this and other
countries. The marketplace has developed a detailed, precise method of
deflecting all claims, and they do not mind who they defame, who they
destroy, who they malign, and how much irrelevant personal information they
publicize (part of their strategy) in order to intimidate you out of claims
  for injuries or disability.

There are wonderful, super, patient advocates, fine surgeons, and healers out
there. There are also, dressed in the same uniforms, a generation of medical
terrorists, who don't give a flip about you, your problems; they are in it
for the dough, and you are simply an object to manipulate and maneuver in any
way they see fit, for THEIR purposes, and there are insurers out there
sitting around all day figuring out NEW and innovative ways to dodge claims
and evade their responsibilities, demanding that YOU pay your premiums on
time, every time, but if you are involved in an accident, particularly
involving pain and suffering, they will bring in the big guns (teams of
Madison Avenue Lawyers and WELL paid so-called 'expert' witnesses, who,
despite all your medical evidence, will declare your problems are all in your
  head.

I urge all of you, having been through this from start to finish, to keep
alert, and to expect responsible and respectful treatment, and....

I urge each and every one of you who are violated, defamed, and/or denied
coverage, to report same to your moderator or me, or to the following
parties, one way or another, we or you will find a way to get the information
to the Mass. Chapter of the Coalition for Patient Rights (CPRNE@tiac.net), in
Boston, and The People's Medical Society, 462 Walnit Street, in Allentown PA.
  18102, phone: ((610) 770-1670, voice, and (610) 770-0607 (fax). Michael
Donio, Director of Projects at the Peoples Medical Society, and Joseph
Schwartz at CPR (Colalition for Patient Rights), NEED TO BE NOTIFIED OF ALL
ABUSES, MISUSES, AND VIOLATIONS OF PRIVACY, DIRECT FROM PATIENTS. I URGE ALL
PATIENTS TO REPORT THEIR NEGATIVE EXPERIENCES TO THESE TWO ADVOCACY GROUPS.
Marketplace policies will stomp on you if you give them a chance. If they do
that to you, report it to these agencies. They have clout.

Do not tolerate being stomped on, mistreated, insulted, demeaned, assaulted
or abused. Report all, ALL abuses and the abusers to the CPR and to the
Peoples Medical Society, and Demand that your state, local, and congressional
representatives are aware of the techniques used on you. Do not take this
personally. It is only big money, getting their way. But there is strength in
numbers. There are people who care.

If your moderator had no passion for public service, he would never have
started this list. If the physicians who started CPR didn't object to the
abuse being dished out to their patients, there would be no hope; but there
are people who care, and there are ways to win. Never let them get you down.
That is their goal. To make you give up and surrender.

Also, NEVER sign any contract or doctor/lawyer agreement without reading each
and every wordof it. You may forfeit ALL your rights in one swift swipe of
  the pen.

Stand you ground and keep the faith. The very fact that new members are
signing on every day shows there is a need for connection. Competition kills,
  connection heals.
