Thanks for all the replies; it tells me some interesting things about the
history of IP. Krishna and Michael, may I forward your replies to the other
lists (CPSR-hosted) I posted my message to?
The reference to the DMCA surprised me. It proves that I'll never know the
whole law no matter how much I study the big mother. I just reread Sections
402 and 405 on "ephemeral recordings," where I'd expect the requirement to
be located, and couldn't find a hint of it. Is it real?
I'm even more interested in what I learned about the Audio Home Recording
Act. I've seen occasional references to it, but I don't think the Internet
public-interest folks discuss it with the intensity they've talked about
the DMCA and other clearly digital laws. So I was ignorant of it. But the
part quoted by Prof. Davis shows that it offers some obvious precedents for
the issues being debated in the digital world (like technical measures).
