I am not a lawyer (although I got to meet with one next
Friday to discuss some tweaks to our contract at O'Reilly
Media, so I can ask questions) but I know our contracts talk
about "exclusive rights." We mean it in a very different way
that is not really like copyright. It's just a contractual
agreement that we're the only ones who can distribute a
book. If they author wants to keep the copyright it's OK
(although we don't recommend it because they it rests on him
to defend it) SO LONG AS we have the exclusive right to
print and distribute.

None of which applies to books under open licenses, of which
we have a dozen or more.
