FRENCH SOFTWARE INDUSTRY AUTHORIZED
TO TRACK AND MONITOR P2P DOWNLOADERS
The CNIL, the French Data Protection Authority decided to allow =20
Software Industrials to track and monitor file exchanges on P2P =20
networks. Regardless the Data Protection Act of 1978, Software =20
Industrials are now allowed to send "prevention" messages, and collect =20=
IPs of people "severely" infringing their copyright.
The =91Association Des Audionautes=92 (ADA) is opposed to the decision =
of =20
the CNIL and we want to point out that the 2002 report of the CNIL =20
mentioned that even the databases created by the French Department of =20=
Justice contained more than 25% of errors and omissions. What will it =20=
be like under the direction of industrials who are not even Police =20
Officers?
We also express our worries that there will be no control for the =20
"prevention" messages sent by the industrials to P2P users. Nothing =20
will assure that theses messages will be legally valid and reflect =20
reality.
Also, the ADA is impressed that industrials will be allowed to track =20
and monitor P2P users without any warranty for citizens.
The decision is immediately applicable but the ADA is looking forward a =20=
possible appeal to the French Supreme Administrative Court.
