Who is to say they are more important than the obvious differences? And
can they please do so in the form of a falsifiable argument?

If there cannot be a right or wrong focus then context does not matter;
it is at best an amusing diversion.
"Intellectual Property", like "Piracy", is a term so loaded, broad, and
complicit that it hampers reasoned debate by making any criticism look
like an attack on common sense. Arguing that this is just one discourse
amongst many is making a value judgement by suspending one.
