Well berne and the EU only organize a set of very minimum requirements
like the principle of copyright in itself. They don't really impose
rules to signatories.
As an example, the EU directive on DRM from march 2001 has been
implemented in completely different ways all over Europe : download is
now stated as legal in the Spanish Penal Code, nothing is mentionned in
the German Act, it's forbidden in Greece (or in Austria?)...
Without even mentionning that interpretation of Bern and EU directives
is left to national Courts and thus it can vary from one country to
another.
