Roche is blowing smoke on this one, because as discussed on this list
earlier by USTR, Brazil only agreed to prior notice on a compulsory
license if issued on the grounds of local working, which is *not*

Daniel Piller, spokesperson for Swiss pharmaceutical group Roche, said
yesterday that Brazil will have to inform the US authorities of its
decision
to break the patent on its Nelfinavir Aids drug. According to Roche, the
drug was developed and patented by Agouron, a subsidiary of the US
pharmaceutical group Pfizer, and the US authorities must be informed of
any
decision to break the patent.
Meanwhile, Roche's Brazilian subsidiary continues its price cut
negotiations
with health minister Jose Serra.
