IVAX says appeals court clears way for generic Taxol

NEW YORK (Reuters) - Drug maker IVAX Corp. said on Monday an appeals
court has cleared the way for the company's generic form of
Bristol-Myers Squibb Co.'s blockbuster cancer drug, Taxol. 

Miami, Fla.-based IVAX said the U.S. Court of Appeals for the District
of Columbia circuit denied a motion by American BioScience Inc. to block
U.S. regulatory approval granted to IVAX to market the generic drug. 

Bristol-Myers produces Taxol. American BioScience has a patent on the
key chemical in Taxol, paclitaxel. 

Privately held American BioScience claimed Ivax violated the patent, but
on Oct. 4, IVAX said a U.S. District Court in Washington rejected a
request for an injunction.
