Subject: FTC Enforcement Actions Announced

List-serv members may be interested to know that the FTC today announced an
administrative complaint against Hoechst Marion Roussel, Inc. and Andrx
Corp., and settlement agreements with Abbott Laboratories and Geneva
Pharmaceuticals, Inc., challenging agreements between branded drug
manufacturers and generics under which the generics agreed to keep drugs off
the market during the pendency of patent litigation.  The FTC press release
is attached.

These agreements will be the subject of a program sponsored by the
Intellectual Property Committee that I am moderating on "Settlement of
Pending or Threatened Litigation: Antitrust Pitfalls" during the ABA
Antitrust Section Spring Meeting in Washington, on Thursday April 6, at 1:30
p.m.  Speakers will include Molly Boast, FTC Senior Deputy Director of the
Bureau of Competition; George Cary, Cleary Gottlieb Steen & Hamilton; and
Robert Hoerner, Jones Day Reavis & Pogue.
