To appreciate how US "March-in Rights" work on patents with US rights on
the legend, see:

in particular, 650.13

The executive branch is stuck with the statute, but could modify the
regs if it wanted to.  But March-in rights can be done without changing
either the statute or the regulations.  

Note that US March-in rights apply to the following HIV/AIDS drugs:

   ddI
   ddC
   d4T
   Abacavir
   Ritonavir
