<p>THE ARTICLE about a proposed $50 million electronic medical records project by Blue Cross &amp; Blue Shield was distressing (Business, Oct. 21). The project would result in a violation of patient privacy at a time when privacy laws have supposedly raised awareness of this issue.</p>
<p>Blue Cross-Blue Shield makes the false assumption that every doctor/clinician a patient sees has a right to access all of the patient's medical records. It is the patient, not the clinician, who controls his medical record.</p>
<p>There are many reasons why a patient may not want records accessed by a clinician.  All clinicians need to be reminded that to access any records without  the consent of the patient is a privacy violation from which liability flows.</p>
<p>I have been a hospital attorney for two decades and have seen the folly of this rush to computerized records. The records are often inaccurate and incomplete and distract the physician from  relating to the patient.  I hope that the ACLU will fight this project.</p>
