VA ASSISTANT ATTORNEY GENERAL CONTACTS LICENSED TO KILL, INC

On May 22, 2003, the Assistance Attorney General of Virginia, Carla
Collins,  sent a letter to Robert Hinkley, the initial director of
Licensed to Kill, Inc.  Here is what she had to say:

<< It has come to this office's attention that you are listed as an
initial director in the Articles of Incorporation for Licensed to kill,
Inc. The stated purpose of the corproation, according to the Articles,
is "to engage in any business...the manufacture and marketing of tobacco
products in a way that each year kills over 400,000 Americans and 4.5
million other persons worldwide."  Please advise as to precisely what
product your corporation intends to manufacture and market.  Please also
specify how the corporation intends to do so.  While the State
Corporation Commission is not tasked with policing the intent of a
corporation, this office is concered with the safety and welfare of the
citizens of the Commonwealth.  Certainly, it would be inadvisable for
your corporation to engage in unlawful conduct in Virginia. >>

And here's an excerpt from Robert Hinkley's letter of response:

<< Your letter indicates that it was written because the Attorney
General's office "is concerned with the safety and welfare of the
citizens of the Commonwealth". In this regard, may I ask you if the
Attorney General's office has sent similar letters to the directors of
other tobacco companies that are already killing thousands of Virginians
each year? Or, may I assume that your concern with respect to Licensed
to Kill will disappear if our company decides to manufacture and market
tobacco products in the same manner as those other companies? >>

* Note: Please disregard Hinkley's misrepresentation of the reason our
company was incorporated and his lengthy discussion of "The Code for
Corporation Citizenship". It is all a smokescreen.  In reality, our
corporation couldn't care less about the welfare and safety of
Virginians.  But from time to time, it is necessary for tobacco
companies to feign interest in public health in order to prevent
legislation that would hurt their profits.
