Last year the Brazilian Working Group of Intellectual Property celebrated t=
he rejection of the Law Bill n=BA. 29/2006 proposed by ex-Senator Ney Suass=
una that attempted to include the linkage mechanism to the Brazilian IP leg=

However, recently in the 16th of December 2009 it was proposed a new law bi=
ll (n=BA. 6654/09) by Congressmen Darc=EDsio Perondi (PMDB/RS) that aims to=
 establish the linkage mechanism. This law bill aims to obligate ANVISA (Br=
azilian Health Surveillance Agency) to reject a drug registration if the ap=
plicant is not authorized by the patent owner of such drug.



One important point is that drug registration in not linked to patents. The=
 linkage mechanism is an obstacle for the entrance of generic medicines in =
the market.
