legitimate generic medicines transiting through the EU on their way to=0D
developing countries, have attracted the criticism of WTO Member States=0D
and civil society alike. Conducted on the grounds of suspected patent or=

trademark infringements, the detentions intercept legitimate trade, and=0D
could impact the affordability and availability of generic medicines in=0D
developing countries.=0D

The incidents highlight questions about the compatibility of EC customs=0D
Regulation 1383/2003 and proposed provisions in free trade agreements with=
=0D
WTO Member States obligations under the TRIPS Agreement, in particular=0D
the Doha Declaration on the TRIPS Agreement and Public Health, and in=0D
relation to GATT.=0D

MSF will explore the legal and practical effect of these issues for=0D
access to medicines in developing countries, in a roundtable with=0D
academics, member states, suppliers of medicines, civil society=0D
organisations and representatives of the pharmaceutical industry.=0D
