The European Parliament,=0D
=E2=80=93 having regard to Rule 123 of its Rules of Procedure,=0D
A. whereas only one third of the 10 million people in need of=0D
antiretroviral treatment has access to it and the price of medicines is on=
=0D
the rise, with increasing numbers of AIDS patients failing on their=0D
first-line therapy, and there is an urgent need to find affordable=0D
second-line treatments,=0D
=0D
B. whereas two million children are living with HIV but less than 10=
=0D
% of them have access to the medicines they need, and many of the=0D
antiretroviral (ARV) drugs available are not approved for paediatric use,=
=0D
=0D
C. whereas UNITAID has decided to take steps to create a voluntary=0D
patent pool for AIDS medicines for developing countries,=0D
=0D
D. whereas, a patent pool is a mechanism whereby patents held by=0D
different parties are brought together voluntarily, in exchange for=0D
royalties, and made available for production and further development,=0D
=0D
1. Calls on the Commission, the Council and the Member States of the=
=0D
EU to recognise the need for the UNITAID patent pool to ensure=0D
availability and affordability of HIV medicines for developing countries=0D
and to actively support the UNITAID HIV patent pool;=0D
=0D
2. Calls, together with international humanitarian organizations, on=
=0D
the pharmaceutical companies to help accelerate the availability of new=0D
treatments for millions of people living with HIV/AIDS, by pooling their=0D
patents on a list of key HIV medicines;=0D
=0D
3. Instructs its President to forward this declaration, together with=
=0D
the names of the=0D
Signatories, to the Commission, the Council and the Member States.=

=0D
