Greetings from Lawyers Collective HIV/AIDS Unit!



We write again to bring you an update on the Novartis case.



As mentioned in our update posted on 18 October 2008, the hearings of the a=
ppeals filed by Novartis AG challenging the Indian Patent Controller=92s de=
cision to reject its patent application for the beta-crystalline form of im=
atinib mesylate (Gleevec) are scheduled to commence.



Today, the Intellectual Property Appellate Board (IPAB) comprising Shri Z. =
S. Negi (Judicial Member) and Shri P. C. Chakraborty (special Technical Mem=
ber) convened in Chennai to issue directions.



As per directions issued today, the hearings of the appeals will commence o=
n 17 November 2008. The hearings are expected to continue on a day-to-day b=
asis and spill over into the next week.



We will post daily updates when the hearings commence.
