The International Centre for Trade and Sustainable Development (ICTSD) and =
the United Nations Conference on Trade and Development (UNCTAD), in the con=
text of their joint programme on Intellectual Property and Sustainable Deve=
lopment, are pleased to invite you to a panel discussion on: "The Global IP=
Enforcement Debate: New Economic Perspectives and Policy Challenges".
The enforcement of intellectual property rights (IPRs) has gained prominenc=
e in recent years in the global trade and intellectual property agenda. A n=
umber of developments at the global, regional and bilateral levels carry fa=
r-reaching implications for the regulation of the knowledge economy. Just a=
few days ago, the G-8 Summit called for the conclusion of talks on a new A=
nti-Counterfeiting Treaty (ACTA) by the end of this year. In June, a French=
court fined Ebay for permitting the selling of counterfeit products on its=
website for the unprecedented amount of 40 million euros. At the same time=
, one of the recommendations of the WIPO Development Agenda, adopted last S=
eptember by WIPO General Assembly, underlines the need "to approach intelle=
ctual property enforcement in the context of broader societal interests and=
especially development oriented concerns," in accordance with Article 7 of=
the TRIPS Agreement.
The main purpose of this activity is to contribute to the current debate on=
IP enforcement by providing new perspectives on the economic aspects of IP=
enforcement, as well as insights into the challenges raised by recent init=
iatives in this area for the promotion of a balanced and development-orient=
ed IP regime. ICTSD and UNCTAD have invited for this occasion two distingui=
shed scholars who are in process of finalising commissioned studies address=
ing salient aspects of the current debate on IPRs enforcement:
Carsten Fink, Visiting Professor, Sciences Po (on leave from the World Bank=
) will present the main findings of his work on the economic aspects of the=
IPRs enforcement. He will highlight the importance of the economic perspec=
tive to better inform the current debate and initiatives in this area.
Carlos Correa, Professor at the University of Buenos Aires, will present th=
e findings of his work on the rationale of the current drive for new enforc=
ement standards and its implications. Carlos Correa offers this perspective=
with a focus on the balance between innovators/creators and users as refle=
cted in the TRIPS Agreement.
The presentations will be followed by commentators and an exchange of views=
with participants. We hope you will be able to attend and participate in a=
lively exchange of ideas and contribute with your experience and expertise=
to this discussion.
