PUBPAT announced on Jan/23 that the U.S. Patent & Trademark Office has=0D
rejected [non-final rejections] four key HIV/AIDS drug patents held by=0D
Gilead Sciences that relate to tenofovir disoproxil fumarate (TDF). Gilead=

markets TDF in the United States under the brand name VIREAD and as a part=
=0D
of its ATRIPLA combination product.=0D
The Gilead Sciences TDF patents challenged by PUBPAT that have now been=0D
rejected by the Patent Office are U.S. Patents No. 5,922,695, 5,935,946,=0D
5,977,089 and 6,043,230.=0D

NOTE: The above 4 are the OB listed patents for Tenofovir.=0D

Such non-final rejections are not extra-ordinary for patents where=0D
re-examination has been asked for.=0D
Pfizer too has had similar problems for Atorvastatin [Lipitor (R)]=0D
patents. Gilead still has the opportunity to address the PTO=E2=80=99s reje=
ctions.=0D
