COLOMBIAN DELEGATE ACTING RIDICULOUS AGAIN.
Lastyear, during the IGWG, the delegation of Mexico was rated as the mostco=
nservative and the champion in becoming the spy of developedcountries, espe=
cially the United States, to break the hard consensusachieved by developing=
 countries .Weare talking about the meeting of the World Health Organizatio=
n onIntellectual Property, Innovation and Public Health, which began onMond=
ay in Geneva. This meeting is the result of the CIPIH, whichconcluded, amon=
g other things, that the current system of patents andintellectual property=
 has not been able to resolve the health problemsof developing countries.As=
expected, developed countries, especially the United States, aredefending t=
he interests of their industries and have objected almostany consideration =
of public health limits to the rights of patentowners.  They are also oppos=
ing discussion within the WHO regarding theeffect of intellectual property =
and patents on health, and haveespecially pressured for the exclusion of di=
scussions on alternativesto the prevailing model for innovation.Lastyear, M=
exico forgot its condition and moved in defense of the proposalsand interes=
ts of rich countries, especially the United States.  In avery active and vi=
sible manner, it was defending positions in somecases more extreme than tho=
se of developed countries.  Last year,Colombia followed Mexico, supporting =
many of these proposals, andproposing some others on their own. But never w=
ith the visibility ofMexico.Nevertheless,the Colombian delegate shined due =
to his evident ignorance and lack ofawareness of the topics under discussio=
n. From the civil societyorganizations=92 point of view, it was evident tha=
t the main intentionwas to show very clearly Colombia=92s disposition towar=
ds agreeing on anFTA, but in the opinion of everyone (in this case there wa=
s a completeconsensus) he acted ridiculous.Thisyear, Mexico has been modera=
te. Instead, the delegation of Colombialearned nothing and continues to pla=
y the fool. But this year is muchmore evident and striking.Thebad news is t=
hat this ridiculous attitude is bombing the consensus ofdeveloping countrie=
s, and is calling into question the competence ofthe World Health Organizat=
ion to discuss the health effects ofintellectual property. It is blocking p=
rogress within the WHO and goingback on progress already achieved. And it a=
lso ignores Latin Americancountries=92 efforts to reach agreements in these=
 programmatic issues.Colombia did not attend any of meetings on these matte=
rs held inBolivia, Brazil, the United States, Canada or Suriname. However, =
thatabsence does not seem to impress Dr. Echeverri, who has shown a poorres=
pect for his colleagues in the region, and a memorable lack ofprudence.InCo=
lombia we have already seen many times how far the government can goin doin=
g almost anything that can contribute to the adoption of an FTAwith the Uni=
ted States. And obviously someone from the highest levelbelieves that drawi=
ng ridicule at IGWG could be useful.TheCivil Society Organizations at IGWG,=
 by consensus, have decided toconfer the stupidity award to the Colombian d=
elegate, Dr. Echeverri,whom, by the way, is not representing the Ministry o=
f Social Protectionin Colombia, and certainly does not represent the intere=
sts of theColombian Public Health.Hereare some examples that have made him =
deserving of the prize, and take alook at the context: consensus had been a=
chieved regarding theinclusion in a negotiating text on the desirability of=
 promotingresearch in health systems under open source models. A consensus =
thatmight seem obvious, since even the richest countries had objected. ToDr=
. Echeverri, namely the delegation of Colombia, the words 'opensource' shou=
ld not be mentioned. More than two hours of deliberationswere lost in expla=
nations and discussions, without a change. Even theUnited States supported =
the consensus, considering that even in thisarea there are many companies t=
hat operate based on open source (inColombia also, by the way). In the end,=
 the text was adopted with thelegend =93consensus except for Colombia=94=85=
=85=85Dr.Echeverri represents the government, and his legitimacy isunquesti=
onable. But we can certainly question the legitimacy of what ishe doing, an=
d what he says. Obviously he is part of a process directedtowards bombing d=
iscussions about the benefits of innovation in healthand about the best int=
erests of developing countries. This is toprevent the success of negotiatio=
ns within the WHO.
COLOMBIA HACIENDO EL RID=CDCULO DE NUEVOEla=F1o pasado, durante la reuni=F3=
n del IGWG, la delegaci=F3n de M=E9xico fuecalificada como la m=E1s retarda=
taria, y la campeona en convertirse en laquinta columna de los pa=EDses des=
arrollados, especialmente los EstadosUnidos,  para romper el dif=EDcil cons=
enso que hab=EDan podido conseguirlos pa=EDses en desarrollo.Estamoshabland=
o de la reuni=F3n de la Organizaci=F3n Mundial de la Salud sobrepropiedad i=
ntelectual innovaci=F3n y salud p=FAblica, que se inicio hoy enGinebra.  Es=
ta reuni=F3n es el resultado de la Comisi=F3n de la OMS sobreel mismo tema,=
 que entre sus muchas y muy importantes conclusiones, dejo sentado que el a=
ctual sistema de patentes y propiedad intelectual,no ha sido capaz de contr=
ibuir a la resoluci=F3n de los problemas desalud de los pa=EDses en desarro=
llo.Comocabria esperar, los pa=EDses desarrollados, especialmente los Estad=
osUnidos, defienden los intereses de sus industrias, y se han opuesto aque =
cualquier consideraci=F3n de Salud Publica limite los derechos de lospropie=
tarios de las patentes.  Se han opuesto igualmente a que la OMSdiscuta la f=
orma en que la propiedad intelectual y las patentes afectanla salud, y espe=
cialmente, ha presionado para que se evite cualquierdiscusi=F3n sobre alter=
nativas al modelo hoy imperante.Ela=F1o pasado, M=E9xico se aparto de sus c=
ompa=F1eros de condici=F3n y cerr=F3filas en defensa de las propuestas, int=
ereses y posturas de los pa=EDsesricos, especialmente los Estados Unidos. I=
ncluso, de manera muy activay notoria, interven=EDa en las discusiones en d=
efensa de posturas que enm=E1s de un caso, eran m=E1s extremas que las de l=
os propios pa=EDsesdesarrollados. Y el a=F1o pasado, Colombia hizo la segun=
da, respaldandomuchas de tales propuestas, e incorporando algunas de cultiv=
o propio,en la misma l=EDnea. Pero nunca con la visibilidad que tuvo M=E9xi=
co.Sinembargo en aquel entonces Colombia brillo con luz propia por eleviden=
te desconocimiento de los temas en debate, y por lo inoportuno demuchas de =
sus intervenciones. A criterio de las organizaciones de laSociedad civil de=
 diferentes pa=EDses, hab=EDa un af=E1n de jugar un papelque pudiera ser fa=
vorable a la aprobaci=F3n de un Tratado de LibreComercio; pero a criterio d=
e todos, (en eso hubo un completo consenso)hizo el rid=EDculo.Estea=F1o, M=
=E9xico se ha caracterizado por su prudencia.  En cambio ladelegaci=F3n de =
Colombia no aprendi=F3 mayor cosa y sigue haciendo elrid=EDculo. Pero este =
a=F1o es mucho m=E1s evidente y llamativo.Lamala noticia es que se trata de=
 un rid=EDculo que est=E1 bombardeando losdif=EDciles consensos de los pa=
=EDses en desarrollo,  que est=E1 cuestionandola competencia de la Organiza=
ci=F3n Mundial de la Salud para discutir losefectos en salud de la propieda=
d intelectual y que est=E1 jugando unpapel de bloqueo a los avances que en =
el seno de la OMS ya se hab=EDanconseguido. Y que adem=E1s desconoce el cam=
ino que especialmente lospa=EDses de Am=E9rica Latina han recorrido para ll=
egar a acuerdosprogram=E1ticos en estos temas. Colombia no asisti=F3 a ning=
una de lasreuniones que sobre el tema se celebraron en Bolivia, en Brasil, =
enEstados Unidos, en Canad=E1 y en Surinam, sobre estos asuntos. Pero esaau=
sencia no parece impresionar al Dr. Echeverri, quien ha hecho gala deun pob=
re respeto por sus colegas de la regi=F3n, y de una falta deprudencia memor=
ables.EnColombia hemos visto ya muchas veces como el Gobierno est=E1 dispue=
sto ahacer casi cualquier cosa que pueda contribuir a la aprobaci=F3n de un=
TLC con los Estados Unidos.  Y evidentemente alguien de m=E1s altonivel,  c=
onsidera que llegar al rid=EDculo en la OMS puede ser =FAtil.LasOrganizacio=
nes de la sociedad civil, por Consenso, han decididootorgarle el premio a l=
a estupidez, a la delegaci=F3n Colombiana y a surepresentante el Dr. Echeve=
rri, quien por otra parte no viene enrepresentaci=F3n del Ministerio de Pro=
tecci=F3n Social en Colombia, yciertamente no representa los intereses de l=
a Salud P=FAblica Colombiana.Veamosalgunas de las perlas que le han hecho m=
erecedor del premio, ymir=E9moslas en su contexto;  Se hab=EDa conseguido u=
n consenso respecto dela inclusi=F3n en un texto de negociaci=F3n, sobre la=
 conveniencia depromover investigaciones en salud bajo sistemas de c=F3digo=
 abierto.  Unconsenso que podr=EDa parecer obvio, pues ni siquiera los pa=
=EDses m=E1sricos se hab=EDan opuesto. Para el Dr. Echeverri, es decir, par=
a ladelegaci=F3n de Colombia, no debieran mencionarse las palabras =93c=F3d=
igoabierto=94.  M=E1s de dos horas de deliberaciones se perdieron  enexplic=
aciones y debates, sin que Colombia modificara su postura.Incluso los Estad=
os Unidos apoyaron el consenso, por considerar que aunall=E1, hay muchas em=
presas que funcionan con base en c=F3digo abierto. (En Colombia tambi=E9n, =
por cierto). Al final, el texto fue aprobado, conla leyenda; consenso excep=
to por Colombia=85=85=85ElDr. Echeverri  representa al Gobierno y en tal se=
ntido no podemoscuestionar su legitimidad para estar sentado en la mesa de =
negociaci=F3n.Pero ciertamente podemos cuestionar la legitimidad de lo que =
hace y loque dice.  Evidentemente se trata de bombardear un proceso de disc=
usi=F3nsobre los beneficios de la innovaci=F3n en salud y sobre los interes=
es delos pa=EDses en desarrollo.  Se trata de evitar el =E9xito de lasnegoc=
iaciones en el seno de la OMS.
