RE: REQUEST FOR AN OPEN LICENSE

Dear Sir:
The Group of Organizations working in HIV/AIDS, representing the
Colombian  League of the fight against AIDS, Foundation Hope
Worldwide, Corporaci=F3n Milagroz, Fundaci=F3n Tejedores de vida,
Fundaci=F3n Huellas de Arte, Fundaci=F3n Henry Ardila, ASIVIDA, ASVIHDA,
Fundaci=F3n Voluntarios del Mundo, Fundamor, Fundaci=F3n Procrear,
Proyecto Girasol, Fundaci=F3n Arenosa Vive y Corporaci=F3n Viviendo con
Dignidad, fourteen institutions dedicated to work in HIV/AIDS, in
Bogot=E1 and other regions of the country, and RECOLVIH Colombian
Network of People Living with HIV, all civil society organizations,
hereby request an OPEN LICENSE authorizing any person, business or
company to use any patent held in the Republic of Colombia by Abbott
Laboratories and its affiliates, including patents held in common by
Abbott Laboratories and other entities, to produce, manufacture,
import, export, distribute, offer in liquidation, sell, buy or use
the medicine known commercially as Kaletra (lopinavir/ritonavir).

Considering that the right to life, the right to real equality and
the right to access to health services are social and fundamental
rights of constitutional scope, and additionally the Universal
Declaration of Human Rights and the International Covenant on
Economic, Social and Cultural Rights, wherein the right to health is
considered a fundamental human right, and taking into account the
social function of property, it is important to advance actions to
optimize resources, reduce costs and increase coverage as a principal
objective, which in conjunction with other measures will improve
access to heath services, with effective, timely and high-quality
treatments.

In addition, the Intersectoral Plan in response to HIV/AIDS
contemplates as priority objectives, among others, slowing the
progression of AIDS and the appearance of resistance to
antiretroviral treatments, which involves strategies to achieve
greater coverage with ARV medicines.  The increase in demand for this
medicine has become an issue of public interest, given the
limitations of resources for ARVs in our country.

An open license for Kaletra will permit its local production or the
importation of less expensive versions, without diminishing the
quality and efficacy of the original medicine, hence the health
sector, public finances and specifically people living with HIV/AIDS
in Colombia will benefit from the grant of this Open License.

The requested license will be subject to the following conditions:

a. A four percent (4%) royalty to the patent holders.  If there is
more than one patent holder, the four percent (4%) royalty will be
divided between them.

b. The royalties described in (a) will be paid to the patent holder
each trimester, with royalty payments no later than thirty days after
the end of each trimester.

c. The duration of the authorized use shall be for the period of the
patent.
