For those interested in Canada=92s law on compulsory licensing of
pharmaceuticals for export, Radio-Canada=92s flagship French-language news
programme, Le T=E9l=E9journal, carried a full feature last night (October 2=
5,
2007) on =93Canada=92s Access to Medicines Regime=94 and the recent issuing=
 of a
compulsory licence to permit export of a generic fixed-dose ARV
(AZT+3TC+NVP) to Rwanda.  It includes interviews with Stephen Lewis,
M=E9decins Sans Fronti=E8res, the Canadian HIV/AIDS Legal Network, generic
manufacturer Apotex, and brand-name company Shire Biochem.

Unfortunately, it implicitly repeats the common error that compulsory
licensing is reserved for emergency situations.  It also glosses over just
how the licence for Apotex came into being, glossing over the fact that it
was a compulsory license that was issued, rather than a voluntary licence
being obtained.  However, it does make clear that the current requirement
for case-by-case, country-by-country approaches to using compulsory
licensing is cumbersome, implicitly highlighting the need for its to be
streamlined, as organizations such as the Canadian HIV/AIDS Legal Network
have urged.
