Subject: [AT-IP] France - GSK found guilty of predatory pricing to
huinder generic entry

On Tuesday France=92s Conseil de la concurrence released a decision
penalizing GlaxoSmithKline for having hindered the entry of generic
drugs in hospitals with a predatory policy relative to the price of
an injectable antibiotic. A link to the Conseil=92s Press Release in
English is here:  http://www.conseil-concurrence.fr/user/standard.php?
id_rub=3D211&id_article=3D695

The 80 page decision in French is here: http://www.conseil-
concurrence.fr/pdf/avis/07d09.pdf

=93The predation policy, which focused on a relatively small sized
market (market for cefuroxime sodium was about 1 million euros),
actually had a more global objective for Glaxo, which consisted in
making an aggressive reputation and sending a =93signal=94 aimed at
deterring small sized generic manufacturers from entering the market
of hospital medicines.=94
