India should not opt for DE.However it can provide for test data
protection.Regarding compensation liability as there are more than one
versions or models, the question is whether the concept per se should be
rejected or some model. Cost sharing model has also been suggested.
How India should fulfill obligations under TRIPS 39.3 and what changes are
needed in laws in india for this.
Those who argue against DE do have identical views on this issue.
I think the debate should continue and we should examine the pros and cons
of each model.
