NY CT REFUSES TO ENFORCE AOL FORUM SELECTION CLAUSE
BNA's Electronic Commerce & Law Report reports that a New
York Civil Court has refused to enforce a forum selection
clause in AOL's terms of service that gives Virginia courts
exclusive jurisdiction to resolve disputes between AOL and
its users. The court ruled that the clause violates New York
public policy favoring small claims court adjudication of
low-dollar claims. Case name is Scarcella v. AOL. Article at
