No doubt there will be a few test cases in
this regard, whose outcomes will have been pre-arranged by those filing
them. It won't take long for temporary restraining orders to be issued
summarily, without the usual protections like bonds posted, perhaps
without even an order to show cause, or without the evidenciary
requirements of such an order.
Microsoft has obtained injunctions against Lindows in various European
countries, often without Lindows even having a chance to contest them.
It is trying to use a Dutch injunction to shut down their US
web site. I disapprove of Lindows' business (which consists of adding
non-free software to the GNU/Linux system), but I sent their executive
info about the Hague Treaty. I hope they will warn their customers
about it.
