We had such a vigorous discussion of issues today that we were unable to
get through all the concerns with the draft convention.  We are holding
a follow-up on Monday, March 8, from noon to 1:30, same location (ALA)
and same call-in number - see below for details.  Please join us & bring

The  roundtable discussion on The Hague developments is being 
re-scheduled for Friday, March 5, 2004 (from Thursday March 4).  We
apologize for moving the meeting once again, but we encountered an
irreconcilable conflict!

corner of 13th & E Sts).  Feel free to bring your brown-bag lunch.

Jeff Kovar of the U.S. State Department and other members of the U.S.
delegation will be present.

In addition to the issues related to the weakness of proposed "escape
clause" when facing a choice of forum in a non-negotiated contract,
there are issues about what is "excluded" from the scope (Article 1 (3
(k) & 1 (4) ie validity of patents, trademarks, protected industrial
designs, layout-designs of integrated circuits AND "other intellectual
property rights" and issues about the interim measures and enforcement
(article 6).

Negotiation will continue on the draft convention, with another
meeting
set for April 2004 in The Hague.   If that session goes well, there
may
be a
Diplomatic Conference to conclude the treaty in November or December
2004.
