Today was an exciting day at WIPO day 2 of the negotiation on the proposed
casters=92 treaty (even for the chair who said so at the end of the long
day).
It started with China=92s great statement regarding doubts about the need
for broadcasters to get more rights than they have (why Rome+?) and
difficulties accepting the need to protect webcasters who are more likely
to be infringers than infringing upon (they have a point). Then there
were discussions about TPM which appear to be STILL (can you believe it?)
controversial.
Because the chair had decided to speed up the process the delegations were
asked to make statement on alternatives that could or could not be dropped
=93to clean up the draft=94. I was surprised during the discussion on Arti=
cle
14 (Limitations and Exceptions) where the US had proposed a good provision
on special treatment for public broadcasting (grandfathering the special
exception). It appeared as if the US was ready to =93compromise=94 (drop i=
t?)
if the 3 step test could be used instead.
I was also surprised (but this time it was a pleasant surprise) during the
discussion on the term. Until last meeting only a term of 50 years had
been proposed in all proposals. Haowever, last meeting Singapore proposed
20 years (as in the Rome) and was supported by India. Today, several
countries (India, Syria, Chile, maybe Togo?) expressed support for the 20
years putting in questions the 50 years that the casters want without any
other rational that it=92s an update, it=92s has to be more (and like for t=
he
producers to be =93fair=94?).
The most interesting was the discussion on webcasting (the =93key=94 accord=
ing
to the chair) that became funny at times. It=92s obviously what is
=93blocking=94 the progress of the treaty. Countries, except the US and EC
(if it=92s a broadcaster=92s webcast) are all opposed. Proposals to give a
choice of options (no protection, some protection, high protection) for
member states does not seem to make sense on the internet but that=92s wher=
e
the discussion was left. There was a mention of the possibility of a
separate =93protocol=94 or instrument just for the webcasters but we=92ll s=
ee
tomorrow if the SCCR cannot find other important topics (more consistent
with the development agenda maybe?) to work on.
Other than that there was a little scandal because some IP Justice and EFF
documents to be distributed and placed on a table were =93stolen=94 and fou=
nd
in a trash can in the men=92s room. As the chair noted, no one can come in
without going thru security (and a badge) and it looked as if somebody had
done it =93from the inside=94. It was so embarrassing to hear about that a=
ll
delegates agreed that it would no doubt never happen again!
As Robin Gross put it, we need some =93protection measures here=94.
