Find my notes during plenary discussion re IP at wsis, Geneva September
23, 2003
Please note that the US (I believe the delegation includes Jule Segal and
Marla Poor from LOC and Mr. Keplinger USPTO for IP issues) introduced new
words such as "balance...existing in international agreements relating to
IP"...
Brazil (chair of working group) might have referred to that when stating
the changes were not merely"editorial"?

Para 33 [40C]
Nigeria: note typos.
Syria: two comments. In first line term =93essential=94 should be replaced =
by
=93relevant=94
Thirds line add =93in supporting economic and social development=94
New Zealand: We do not like IS repeated 3 times. I would propose change
that in 2d
And =93facilitate=94 ought to begin a new sentence. It=92s repetitive and s=
hould
be condensed
India: We=92re uncomfortable with language of this para. It should be in
bracket, and we should discuss again later, there should be balance
between protection and its use, sharing, and public interest. And this is
not in this para.!
EU we propose to delete third sentence beginning with facilitation. We
shall provide language.
USA: We=92d wish to agree that there is difficulty in English text. We
propose solution for awkward text. We=92d make changes. To begin we leave
first sentence as it is.
Than delete sentence beginning by =93striking=94 and replace with:
Balance between protection of intellectual property, one the one hand, an
its use, and knowledge sharing, on the other, which is reflected in
existing international agreements relating to IP is essential to the
Information Society, facilitating meaningful participation by all in
intellectual property protection and production through awareness,
capacity building and development of legal framework is an fundamental
part of an inclusive Information Society
It would retain the structure.
[..]
Korea: we think there=92s contradiction. IPR is essential in first sentenc=
e
and 2d sentence is about balance. No possible compromise in contradiction.
First should be deleted and 2d one kept
Syria: too many amendments, we support India, we=92re waiting for a new dra=
ft
[?=85]: we listened to many proposals=85quite a number of them. Our stand =
on
this delicate subject would be with US or EU. We want to see them in
writing
Cuba: support South Africa this text was discussed in wg. We should revise
what we have in front of us
Brazil we want to express frustration as chair of group it took us 2 hours
and we cannot fix this in a few minutes. And we cannot accept that this
is about editorial change it=92s substantial. As rep of Brazil, I would
change the text too. But we had a deal, a gentlement=92s agreement. So I
can introduce suggestions on matters of IP!?!
Chair=92s summary: Back to Brazil and working group. All want to make
input meet during tea break.
