1. Update on the UNCITRAL electronic contract formation project with
members of the US Delegation Harold Burman, Tom Smedinghoff, Henry
Gabriel and possibly Bill Luddy. Main issues are whether consumers will
be excluded in some fashion and whether the IP exclusion will stay.
There's also question on whether the scope of the convention is going to
expand.
See Working Group IV (E-commerce) met for 41st session, 5-9 May 2003,
New York. Agenda and more at: http://www.uncitral.org/en-index.htm
2. Update on WIPO Broadcasters' rights Treaty (Marla Poor, LOC).
Broadcasters want rights to protect themselves from signal piracy. There
are many issues such as ISPs' liability, applicable law in international
infringements, resale rights, technological measures and questions such
as whether the treaty is going to grant broadcasters additional economic
rights interfering with existing rights such as distribution rights?
Wipo's meeting on this is June 23-27, 2003. Database treaty is also on
the agenda.
