1. SIIA strongly opposes the intellectual property-related provisions
of the Declaration (para. 7,9,10,21,22 and 50) and the Action Plan
(para. 12 and 34), especially those relating to software and databases.
SIIA supports enactment of adequate and effective domestic and foreign
intellectual property laws that protect the rights of intellectual
property owners and allow for the vigorous enforcement of those rights.
First and foremost, appropriate laws must be enacted. "Appropriate" in
this context means that the laws should: acknowledge the rights of
creators and owners of intellectual property products and services,
including software and databases; be comprehensive and leave no doubt as
to what rights and remedies are granted in the law; comply with the
international standards for the protection; and set civil and criminal
penalties sufficiently high to deter infringement.
As the principal trade association for code and content providers, SIIA
is an active proponent of the enactment of domestic and foreign laws
that provide strong intellectual property protection for software and
information products and services. Because no other industry suffers as
much loss from theft as the software industry-some $11 billion worldwide
in 2002-SIIA also has a significant interest in ensuring that
governments take immediate and affirmative steps to thwart piracy and
other thefts of intellectual property.
The conclusions found in these paragraphs that nether computer software
nor databases warrant protection by copyright law is contrary to
well-establish U.S. and international doctrines, laws, and, in some
cases, treaties.
Software: Strong intellectual property protection for software is an
important part of any nation's economic growth and development.
Empirical and anecdotal evidence clearly show the enormous economic and
social benefits of a legitimate, thriving software industry wherever
software is introduced and adequately and effectively protected by a
nation's laws and law enforcement agencies. Although the United States
maintains its strong leadership position in publishing and distributing
software, other nations are also reaping the rewards of actively
encouraging and supporting a strong local software industry. These
rewards are most visible as improved employment and national wealth.
Despite obvious economic and social benefits, the development,
distribution, and marketing of domestically produced software remains
confined to a small group of nations. This is due in large part to the
failure of these nations to encourage its residents, entrepreneurs, and
businesses to develop, distribute, and market software through enactment
and enforcement of strong intellectual property protections for computer
software.
Strong intellectual property protection has numerous economic and social
benefits, including:
• encouraging individuals and businesses to create new copyrighted works
and patented inventions and improve upon existing works and inventions;
• encouraging the creation and maintenance of indigenous intellectual
property industries;
• ensuring the wide distribution of new ideas and technologies;
• promoting investment in the national economy, and
• encouraging technology transfers between nations.
Strong copyright protection is extremely important for computer software
in nonindustrialized countries. The computer software industry is one
area where local businesses can compete effectively with multinationals
in both local and foreign markets. Massive capital investment is not
necessary, nor is acquisition of expensive foreign technology. In fact,
local entrepreneurs often know the local needs and markets better than
the multinationals and can exploit that knowledge. However, without
adequate copyright and other intellectual property protection, those
local companies who create valuable software will soon find that others
will copy their programs without permission and without remuneration,
thereby decreasing their incentives to create and market their programs.
Databases: Databases are of increasing importance and value in the
Information Age. These compilations of facts and data are expensive and
time-consuming to build and maintain, yet their value to researchers,
business, government and everyday citizens is immeasurable. Whether the
database is a directory of names and addresses, a collection of
agricultural, medical or economic data, or a compilation of laws and
court decisions, it is most likely used extensively everyday by someone
who needs to make a quick and accurate decision.
America's database companies-large and small-supply about sixty percent
of the databases available in the world market and have consistently
contributed positively to the U.S. balance of trade. The tens of
thousands of Americans employed by database producers, and the millions
dollars of investment in plant and product, have clearly contributed to
the growth of the nation's economy at the dawning of the Information
Age. Yet, unlike other types of intellectual property, databases are not
protected adequately by uniform federal law, despite their vulnerability
to piracy as technologies for copying and redistribution improve.
Indeed, databases may well become even greater targets for theft and
piracy from competitors and unscrupulous users here and abroad, unless a
new, fair and balanced database law is enacted in the United States and
an international treaty having the same effect are enacted soon.
Demand is growing for more and more information in digital formats, but
it is increasingly easier for technology to be used for copying and
redistributing a database without the owner's knowledge or permission.
In an uncertain legal environment and with clear threats, database
producers will not be willing to provide wide access to these valuable,
reliable and accurate information products. As this industry falters,
many software producers will have to forego business opportunities to
create and market their products and services, especially those that aid
in the search and retrieval of digital information.
U.S. database producers, ancillary industries and database users will
all benefit from meaningful protection of databases. Moreover, such a
law will help secure the predominance of the American database industry
in the world marketplace and foster new attempts to create an
international treaty to bring uniformity to various nation's database
protection efforts. The time has arrived for the United States and
other countries to enact database protection legislation, not to turn
the clocks backward and support the principle – as the Action Plan
recommends – that databases not be accorded intellectual property
protection.
2. The sections in both documents dealing with infrastructure
(Declaration Paragraphs 15-18. Action Plan Paragraphs 1-11) fail to
recognize the important role of the private sector in innovation and
investment in infrastructure. The documents must clearly advocate the
adoption of a policy framework that promotes competition, including
trade liberalization, and private sector investment so that the private
sector can fulfill this critical role.
3. Cultural Diversity and Local Content – (Declaration Paragraphs
48-50. Action Plan Paragraphs 18, 42 and 43): It is important that the
promotion of cultural diversity and local content do not create
unreasonable barriers to trade.
4. Security – (Declaration Paragraphs 35-38. Action Plan Paragraphs
24-27). Industry is deeply involved in and works to support a “culture
of security.” However, business is concerned that these paragraphs
reflect several fundamental misunderstandings about security. We
respectfully urge that strong consideration be given to recognizing the
work of the OECD in its articulation of consensus “Guidelines for the
Security of Information Systems and Networks:
Towards a Culture of Security” that recognizes that different sectors
and different types of information and transmissions necessitate
different levels of security, and laws/regulations do not always account
for such differences
5. Standards – (Declaration Paragraphs 24 and 42. Action Plan
Paragraphs 14 and 30): Any reference to standards should recognize that
they should be voluntary, international, consensus-based and industry-led.
6. Open Source Software-(Declaration Paragraphs 24 and 42. Action Plan
Paragraphs 14 and 28): As an Association that represents companies
with different models of software development – from the strictly
proprietary to open source to those that combine applications from both
– we are concerned that these paragraphs do not reflect the sensitive
issues under discussion within the industry and among users. As a
general matter, multilateral government declarations, including that of
WSIS, should remain neutral with respect to different technologies and
their implementations. Open and competitive procurement policies avoid
market distorting effects and benefit governments and citizens in the
long term.
7. Management of Internet Names and Numbers – (Declaration Paragraph
45. Action Plan Paragraph 33): SIIA believes that private sector
leadership of the management of Internet names and numbers as embodied
in ICANN is the appropriate path to follow. Therefore, we strongly
believe that any reference to an inter-governmental organization
engaging in such management is inappropriate.
8. The Action Plan calls for a Global Digital Compact (Paragraph 45).
It is far from clear that such a “Global Digital Compact” is
warranted. The concept articulated in the Action Plan is not clear
regarding what such an agreement would include and what would be
expected from business.
