Hello everyone.  Hal Burman of the U.S. State Department and Co-Chair of
the Global E-Commerce Subcommittee of the ABA Business Law Section's
Cyberspace Law Committee has asked me to send an announcement of our
first two teleconferences of 2003.  These teleconferences are scheduled
for Wednesday, January 15th and Tuesday, January 21st.  Both calls are
schedule to begin at 4:00 PM (Eastern Standard Time) in the U.S. and
should run for approximately 2 1/2 to 3 hours.

     phone lines (U.S. and International) for everyone to participate,
     please send me an email at <wjl@rh.edu> indicating which (or both)
     of the teleconferences you will be joining.  By return email, I will
     send you the necessary numbers and passcodes.  Your help on this is

*_Background_*:

During the November 19th teleconference, there was a general review of
the UNCITRAL Working Group on E-Commerce sessions in Vienna during
October.  A wide variety of issues from the work on contract formation
to the expansion of the e-contracting project beyond formation to scope,
and more were discussed.  The draft convention, which you may wish to
review prior to the teleconference, was included as an Appendix to the
Secretariat's Working Paper WP.95 which is available at the UNCITRAL
Website.  The direct URL for the English version is:

Since the November teleconference, the Secretariat has published a
Report of the Working Group on E-Commerce - A/CN.9/527 (the Report) and
it is available at the UNCITRAL website and the English version is
directly accessible at:

The Secretariat will be preparing a new draft convention on
e-contracting but it will not be available for our initial
teleconferences.  As you will see in the Report of the Vienna meetings,
however, there is still much work to be done on outstanding issues it
will be possible for us to have a significant impact on the continuing
Working Group thinking.

*_The January 15th and 21st Teleconferences_*:

It's expected that the initial part of the 1/15 teleconference will
briefly summarize the October meeting particularly for those who did not
have the opportunity to join the November teleconference.  Next, we will
identify the principle outstanding issues related to the e-contracting
project as described in the Working Group Report.  Most of these issues
covered in Paragraphs 72-126 (pp. 17-30) of the Report.  These represent
important and difficult issues and it is expected that the Working Group
will be working on them during its next meeting in early May.

We will work through as many of these issues as possible and will likely
continue the discussion on January 21st.  Additionally, there may be
related issues that participants in the teleconference may wish to raise
based on the Secretariat's Report.

The Report also covers the Working Group's discussions of the "Legal
Barriers to E-Commerce" project.  You will find this material in
Paragraphs 24-71 (pp. 7-17.)  As the Secretariat has noted on several
occasions, there are interrelationships between this project and the
e-contracting project and it may be more valuable for the group to focus
on the e-contracting issues during these two teleconferences.

*_Further Teleconferences_*:

It is probable that there will be further teleconferences this Spring.
Additionally, those of you who may be members of various ABA Sections
may want to watch for discussions of the UNCITRAL e-commerce
developments at various meetings this Spring.  For example, a number of
these issues will be discussed at the Business Law Section's Cyberspace
Law Committee's Winter Working Meeting in Atlanta at the end of
January.  Similarly, there will be an opportunity to discuss them, at
least informally, at the Science & Technology Section meetings at the
ABA Midyear Meeting in Seattle.  The Business Law Section's Spring
Meeting in L.A. will also include activities related to these issues.
Thus, there will be many opportunities to participate in these
discussions.  However, the next two teleconferences will provide an
important opportunity to participate defining many of the key issues
involved.

Again, please send me an email indicating your participation in either
or both of the teleconferences.  I will then provide the necessary
information to you by email.
