[Ecommerce] EU Directive (fwd)

As presently drafted the EU directive on e-commerce will NOT deal with the
question of the  applicable law to CONSUMER CONTRACTS or with the question
of the jusrisdiction of courts. 

It provides only for the law of country of origin in relation to "public"
laws such as the laws on marketing or advertising.
The Commission have proposed a seperate measure on jurisdiction providing in
effect the consumers court as the venue in most cases of legal dispute .This
proposal ("on the Brussels Regulation") is fiercley opposed by industry.

The question of the applicable law is currently dealt with in the EU by the
"Rom convention", which applies also to e-commerce transactions.  No new
proposals on applicable law in relation to consumer e-commerce contracts
has  yet been put forward.

Does anyone know whether the proposed EU Directive on e-commerce 
will contain a term providing that choice of law or venue in 
consumer contracts will be where the consumer resides?  Has this 
been settled yet?
