The fact the two code bases have the same segments of code is
not relevant.
It would be interesting to understand when this code was
introduced.
Also, if they can produce the original writer who can testify
"I thought this up" -- then the case would get much more interesting.
The fact that all the linux kernels are available for inspection,
they can say WHEN this code was introduced.
