I strongly suspect SCO's lawsuit is more hot air than a legal case.
It's primary purpose seems to be promoting fear, uncertainty and
doubt. It's strange how SCO people take many opportunities to
interview the media and make a lot of wide-ranging assertions while
IBM remains quiet in the media and acts more like they would actually
like their case to be heard in court.
Also, I don't think SCO helped themselves much when they decided to
retain their Linux distribution, thus releasing all of its code under
the GPL, for 2 months after they filed their "improper trade secrets
dissemination" claim against IBM. Any claims that they "unknowingly"
released code under the GPL would be much weaker now.
Oh, and speaking of their settlement with Microsoft, does the follwing
story
Microsoft Documents to be Shredded in Utah

and its timing just as Microsoft signed a Unix licence agreement with
SCO pique your interest?
