Greetings from across the pond-

Hope this finds the "list" in good spirits...

A couple of things, first, Mitch's memory serves him right in that there
have been several lawsuits, and I believe one in California was successful,
but had no binding remedy, or the penalty was laughable. I suspect the
thread is in the archives from late 1998-early 1999 if memory serves me.

Second, this woman would do better to make it a consumer class action tort
as California has gotten progressively more stringent on software warrantees
(at least from what friends still in the business tell me), particularly in
terms of consumer protection and warrantee validity (It's no longer ok to
wash one's hands of a product's failures). I'm sure the legal beagles on the
list can elaborate more lucidly on this than I.
