Erm...

MS does not yet have legislative powers. Whatever it says in the EULA has 
nothing to do with its legal standing. The EULA is not a statute created 
by the government. I do not believe MS has any power to stipulate the 
environment in which any of its products run irrespective of what it says 
in the EULA.
