Microsoft has challenged the states' authority to continue to pursue the
case
when the U.S. government has reached a settlement.
In an order issued late on Monday, Kollar-Kotelly invited the Justice
Department to comment on Microsoft's assertion that the states are
trampling on the federal government's role in setting national
competition
policy.

This is hilarious! Remember, the current DoJ, who struck the sweetheart
deal with Microsoft, is headed by Republicans.
What is the Republican mantra? "The Federal Government is too big.
More power should be vested in the States."
But now, Judge K-K has asked the DoJ to comment on why the States should
NOT be allowed to pursue their case, and why the Federal Government is
the only big cheese here.
What to do, what to do? The DoJ could argue that the States have no
business in this case, thus violating the most dearly-held principle of
Republicans.
Or it could argue that the States rights are valid, thus destroying its
own position in the case having made an agreement with Microsoft.
Tee-hee!
Good for you, Judge. I can't wait to see their arguments.
