The gloat is premature.
The judge ruled on Microsoft's motion for a preliminary injunction.
The standard for granting a preliminary injunction is relatively
stringent, involving proof of the likelihood of irreparable harm, that
is, harm that cannot be measured in monetary damages. The judge could
easily have believed that the damage to Microsoft from a pesky gnat
pending the trial would be (a) small and (2) compensable in damages.
The ruling at the conclusion of trial often is the direct opposite of
a prior ruling by the same court on a preliminary injunction.
