[Am-info] USvMS post-settlement

Out of curiosity, does anyone have an idea of what the procedure will
be with regard to the US vs Microsoft lawsuit, if the RPFJ settlement
is rejected?

With the dual-track case schedule, apparently the non-settling states
will have presented evidence (or at least held hearings) before JKK has
ruled on the RPFJ. Assuming JKK rejects the settlement, how do the
nine states and the DOJ "catch up" with the other track? Or will there
be two "penalty tracks" for the case?

Will this be a point of appeal for Microsoft? That they had to defend
against the same claims twice in the same court proceeding? That they
didn't have an opportunity to present all the evidence in the first
track since they had to wait for the second?
