The media and the public are not barred from courts of law. Depositions 
are generally not conducted in a court room, and are typically not made 
available to the public or media, though apparently some exception to 
this was carved out in the Tunney Act, an exception which the court says 
does not apply here. I believe this is the correct distinction.
