I wouldn't think that admission or denial of guilt in and of themselves 
would have anything to do with the legal state of the FOF.  Even if the 
DOJ/States said in some settlement "ok, our bad, sorry, all a big 
mistake", the FOF is writ into the books and can't be un-writ be other 
than a court, I would think.

It would be pretty weak for the convicted to party to simply say, "Are 
not!!", in order to vacate the FOF, especially after having been mostly 
let stand by the en banc appeals court.
