Two thoughts on this. First, we still don't know how Motz will rule.
Second, lawyers tend to rapidly lose interest in a case once it looks
like they'll be paid in full no matter how it turns out (it helps if they
can also "declare victory" while pocketing the check). I've seen it
before. I suspect this is even more of an issue in suits without a single
plantiff, such as class action suits.
