I'm confused.
The DOJ couldn't file the expediting request until M$ officially
appealed. So Jackson was withholding his ruling on the behavioral
remedies pending the official appeal notification. So Microsoft files
the appeal notification and immediately files a request to the court of
appeals for a stay of the behavioral remedies, before Jackson has ruled
on it.
And the court of appeals agrees to hear the case, before Jackson issues
his ruling on the stay,and the DOJ can file the expedition request.
Sounds very much like an attempt to outrun the legal system. Is it
legal???
How can the court of appeals be petitioned for a stay before the trial
judge has ruled on the subject?
