Hi Jeremy and All
Thank you for this interview, Jeremy. Here in CH the Federal Institute
for Intellectual Property, who heads the CH delegation to ACTA,
organized an information meeting about it on Jan. 14. They stated very
clearly that the delegation has been mandated by the Federal Council
(govt), with a "Leitlinie" (guideline) that specifies that no change
in the present CH copyright law. When I asked if more drastic
copyright enforcement measures possibly foreseen by ACTA's final
version could be introduced via the copyright ordinance instead, the
answer was no.
Their presentation slides also said: "Nicht Gegenstand von ACTA:
Handlungen Einzelner im privaten Bereich" (Not object of ACTA: actions
by individuals in the private sphere).
Something else strikes me retroactively about that meeting: there were
representatives of the International Federation of Producers of
Phonograms and Videograms (IFPI) and of AudioVisionSchweiz. Now during
the last revision of the Swiss copyright law that came into force in
2008, IFPI and AudioVisionSchweiz had been very loud in their lobbying
for the removal of all restrictions to the interdiction to circumvent
digital copy protections. But for that meeting about ACTA, only
AudioVisionSchweiz had submitted questions in advance, and they were
rather bland: "Criminal procedures in cases of camcording motions
(sic) pictures" (answer: not in Switzerland) and "promotion of public
awareness". Nothing from IFPI. It could be good news, but then again,
not.
