DRAFT conclusions by the Chair re Limitations and Exceptions at SCCR18

These are the draft conclusions distributed by the chair regarding
item 5 of the agenda (i.e. limitations and exceptions). The paper was
distributed before the lunch break (1-3pm). The delegates are
consulting on it and will come back at 3pm. The final text will be
modified of course but this is a good start.

     SCCR 18 DRAFT CONCLUSIONS OF THE SSCR prepared by the chair
     Limitations and exceptions

     1. The Committe reconfirmed its commitment to expedite its work
on the access of the blind, visually impaired and other reading-
disabled persons to protected works.

     2. The Committee expressed its appreciation for the Proposal by
Brazil, ecuador and paraguay Relating to Limitations and Exceptions;
Treaty Proposed by the World Blind Union (WBU). The proposal will be
discussed at the nineteenth session of the SCCR after Member states
have had time to analyse the proposal.

     3. The Committee took note of the stakeholders=92 platform Interim
report, and encouraged the Secretariat to continue the work of the
platform and report on its activities during the nineteenth session of
the SCCR. The Committee requested that the Secretariat explore
possibilities for extra-budgetary funding to support the participation
of stakeholders for developing countries.

     4. The Committee requested the Secretariat to prepare an
analytical document based on document SCCR/15/7: Study on Copyright
Limitations and Exceptions for the Visually Impaired. The analytical
document should identify the most important features of the
limitationss and exceptions for the visually impaired in national law
and index the main legislative solutions in this regard.

     5. The Committee invited delegations to send comments to the
secretariat regarding the draft questionnaire before July 15, 2009.
based on those comments, the Secretariat will present a revised
questionnaire for fianl approval during the nineteenth session of the
SCCR.

     6. The Committee agreed that in relation to both visually
impaired people and libraries and archives questions regarding the
function of limitations and exceptions across borders should be added.

     9. The questionnaire shall enable governments to furnish any
other information regarding limitations and exceptions in their
national law that they might consider pertinent
