      Do you think that perhaps a series of legal challenges in respect to
    restraint of trade and other Constitutional grounds is a good or even
    necessary means by which to achieve eventually your repeal approach?

I am not the best judge of how likely that method is to work in the
next few years.  Based on the Eldridge case, I am pessimistic.  But a
cagy lawyer such as Eben Moglen would judge this better than me.

I will not assume this is necessary.  In the long term we have more
influence over Congress than over the Supreme Court.  In the short
term, however, I think Obama will be worse than Bush on this issue.
