There are issues of rights more fundamental than whether a legal right
ought to be vindicated, and on what timeline it ought to be vindicated
("we don't want to wait...").
If one seeks legislation, that clearly implies (in the absence of
constant clarification to the contrary) that the right presently
doesn't exist and must be created by additional law, treaty, etc.
Figuratively, one is 'on one's knees" with the powers that be.
On the other hand, if a right to access knowledge presently exists on
behalf of the blind or anybody else, then the proper approach is to
demand recognition and enforcement of that right in the courts, in the
streets, or with executive branch officials in charge of the execution
of the law.
Seeking treaty rights without at all times saying in effect "this is
just spelling out existing rights for officials too ignorant to figure
this out" is going down the wrong road, and going down the wrong road
on one's knees, as it were. It disables us all for many reasons, not
the least of which is the implication that remaining DRM regimes are
legal and legitimate.
