Mean forthe Long Term?

Barbara and all,
I wonder how many authors are going to opt-out? Seems to me
this proposed agreement is about as good as the authors are going
to get, but does pose some problems from a security standpoint if
Google, which is not known for it's strong security practices, can
guarantee the authors that their works will not be open to hackers
and crackers that will definitely seek to acquire some works and
than offer them for free to any takers. Given the number of security
breaches Google has suffered in just the past year, I would say that
these authors should be asking of some sort of bonding by Google
in the event such a breach event occurs.

nt in The Authors Guild et al. v. Google Inc., a class action lawsuit broug=
ht against Google in connection with its use of copyrighted books in its Bo=
ok Search feature, and in The McGraw-Hill Companies et al. v. Google Inc., =
a separate lawsuit by publishers. The settlement, if approved by the court=
, will provide new opportunities for authors and publishers to market their=
works. It will also enhance the public's ability to search for books and =
to get partial text displays (and, in the case of many older works, full te=
xt displays) at home, at school, and in libraries. At the same time, the s=
ettlement may have significant implications for copyright law, competition,=
research and scholarship. The settlement embraces copyrighted works in US =
libraries, regardless of whether the rightholders are US or foreign nationa=
ls, unless the right holders opt out, which they must do by May 5, 2009.

ications of the Google settlement for the parties, for other stakeholders w=
hose works are not included in the settlement (e.g., photographers and illu=
strators), and for the public interest.
