Manon and all,
Seems our objections were not listed here. That's a shame.
I also did not see EFF's objections listed in your provided
Epic link either. So I can only conclude that the link isn't
entirely accurate, but is a good overall read.
My two main objections were in respect to promoting the digital
divide in that libraries will only be allowed one terminal or PC for
access and public schools are not allowed any at all. Second, is
that allowing Google or a third party to have access to data collected
uncontrolled or unrestricted is dangerous to users in several ways,
most of which are obvious, the main one being that data being misused
for Internet/email advertising and marketing and IDtheft potential
accordingly. Our members had several other objections which we
sent to Epic and the court officially. These objections mainly are
associated around privacy and fraud concerns.
Other lessor but important concerns is that there was not stringent
provision in this agreement that adequately and specifically defined
what process and it's length of Google's obligation to continue to
search for authors of orphaned works or their surviving relatives,
nor how or if they would be adequately compensated should they
be located and identified or self identify at some future time. Seems
to me that if found, identified or self identified and properly verified,
they should be getting at least 1/3 of whatever gross revenues that
have been collected as a result of those relevant works being used
or sold, including advertising revenues.
