The undersigned, writers and journalists, are writing to ask you to
support the World Blind Union proposal and initiate discussions at the
World Intellectual Property Organization on a treaty to improve access
to works, articles, blog posts, subtitled films, etc in formats
accessible to people who are blind, visually impaired or have other
disabilities that impair access.

People who are blind, visually impaired and have other disabilities
face numerous barriers to access knowledge and enjoy reading. New
technologies have opened up a range of opportunities to improve their
situation, but progress has been slow in improving accessibility.
Today, even in the countries with the highest incomes, fewer than five
percent of books published are accessible to persons with
disabilities. This figure is appallingly low for books written in
English and in countries with strong financial resources. But the
number of books available for people living in developing countries is
unfortunately much lower.

In an ideal world, publishers and authors would publish books and
other materials in formats that are accessible for persons with
disabilities, or give permission to others to create versions that are
accessible. This too rarely happens, and will never happen all the
time. For this reason, more than 60 countries have adopted exceptions
in copyright law to allow the publishing of works specifically for
persons with disabilities, in special accessible formats. However,
these exceptions often do not allow for the importing and exporting of
accessible works. The lack of cross-border use of the exceptions harms
people with disabilities =96 it creates an inefficient system that
requires wasteful duplication of efforts, where there are already too
few resources.

In 1985, WIPO and UNESCO published a report calling for a new treaty
to solve this problem, and create a global system of distributing
works to persons who are blind and have other disabilities. Today WIPO
is considering just such a treaty. We urge every country to move
swiftly to support and enact such a treaty, so that a person who is
blind, or has other severe disabilities, can read what we write.

Los escritores y periodistas abajo firmantes le escribimos para
solicitarles que apoyen la propuesta de la Uni=F3n Mundial de Ciegos en
cuanto a iniciar discusiones en la Organizaci=F3n Mundial de la
Propiedad Intelectual sobre un Tratado para mejorar el acceso a libros
en formatos accesibles para ciegos, personas con deficiencias visuales
y otras discapacidades para la lectura.

Las personas ciegas, con deficiencias visuales y otras discapacidades
para la lectura se enfrentan a numerosas barreras para poder acceder
al conocimiento y disfrutar de la lectura. Las nuevas tecnolog=EDas han
abierto un abanico de posibilidades para mejorar su situaci=F3n pero
actualmente menos de un 5% de los libros publicados son accesibles
para las personas con discapacidades. Esta cifra representa sobre todo
libros escritos en ingl=E9s, gracias a instituciones de pa=EDses con
fuertes recursos econ=F3micos. Pero el numero de libros disponibles para
personas de habla hispana que viven en pa=EDses en desarrollo es
desgraciadamente mucho menor.

En un mundo ideal, las editoriales y autores proporcionar=EDan versiones
accesibles que permitieran su lectura por cualquier ciudadano y les
darian autorizaci=F3n para circular entre pa=EDses. De este modo, no seria

adaptados a formatos accesibles por organizaciones de ayuda a los
discapacitados que invierten sus pocos recursos en cada adaptaci=F3n
local, ampar=E1ndose jur=EDdicamente en excepciones nacionales a los
derechos de autor.

Hay actualmente m=E1s de 150 pa=EDses que no cuentan con excepciones a los
derechos de autor para beneficiar a personas ciegas, con deficiencias
visuales y con otras discapacidades para la lectura. Cuando estas
excepciones nacionales existen, suelen ser bastante restrictivas en
cuanto a formatos y beneficiarios, var=EDan considerablemente de pa=EDs a
pa=EDs, y no solucionan las incertidumbres legales de quienes quieren
intercambiar o ceder estos libros accesibles a organizaciones o
personas que se encuentran en otro pa=EDs. De esta manera, se duplican
esfuerzos y se gastan innecesariamente recursos que son por cierto muy
escasos en los pa=EDses en desarrollo.

La Uni=F3n Mundial de Ciegos lleva muchos a=F1os solicitando un marco
jur=EDdico internacional que posibilite la creaci=F3n de plataformas
globales para facilitar la adaptaci=F3n y distribuci=F3n de libros en
formatos accesibles. La propuesta de tratado para la OMPI armonizar=EDa
una norma m=EDnima mundial para las limitaciones y excepciones en
beneficio de los ciegos y las personas con deficiencias visuales y
otras discapacidades para la lectura, y permitir=EDa la importaci=F3n y
exportaci=F3n de obras en formatos accesibles.

Existen aproximadamente 180 millones de personas ciegas o con
discapacidad visual en el mundo y la Organizaci=F3n Mundial de la Salud
estima que el 90% de ellas, con viven en pa=EDses en desarrollo y est=E1n
intentando incorporarse plenamente a la sociedad y tener acceso al
conocimiento escrito.

Como escritores y autores, deseamos que esos 180 millones de personas
que no pueden leer textos escritos en el mundo tengan acceso a
nuestros libros y escritos en las mismas condiciones que las personas
que no sufren discapacidades. Si se aprobara la propuesta de la Uni=F3n
Mundial de Ciegos en la OMPI, las condiciones de vida de estas
personas mejorar=EDan sustancialmente y se facilitar=EDa el acceso a la
lectura en condiciones de igualdad. Esta es una cuesti=F3n de derechos
humanos que no debe ser ignorada por la OMPI ni sus Estados Miembros.
